According to a DOL announcement on September 11, the Department of Labor (DOL), Occupational Safety and Heath Administration (OSHA) and Wage and Hour Division(WHD) of the Department of Labor are conducting an investigation into workplace safety and violations of child labor at a Hattiesburg poultry plant in Mississippi following the death of 16-year old worker.
In a statement, Courtney Bohannon of OSHA’s Jackson, Mississippi area office said: “As federal agents continue their efforts to determine how the 16-year-old boy died at Mar-Jac Poultry in Hattiesburg,”
OSHA received a warrant for access from the U.S. District Court of the Southern District of Mississippi in order to investigate the safety risks related to this incident. The warrant permits federal officials to privately question agents, employees, employers, and operators, and to review records relating to the maintenance and operation of equipment that was involved in the accident.
Bohannon stated that federal law protected workers’ rights to take part in an investigation by the U.S. Department of Labor and prohibited employers from intervening, even if it meant retaliating on employees who participated. With the help of Mar-Jac workers, we will ensure that Mar-Jac provides a safe environment for all employees.
OSHA invited Hattiesburg Mar-Jac Poultry workers to call the agency, or contact its Jackson office. They could also submit an online confidential complaint. OSHA is working with groups such as the Immigrants Alliance for Justice and Equity of Mississippi, to reach out to immigrant employees who fear retaliation from their employers if they provide information.
OSHA reiterated federal law grants all American workers, regardless of their immigration status, the legal right to a healthy and safe workplace. They can also file a complaint confidentially and ask for an OSHA inspector if there are hazardous conditions at work.

According to OSHA, the company ships 2 million birds per week and 8500 tons of food worldwide. Its primary market is in the foodservice industry.
Missouri contractor facing $205K OSHA fine
Troyer Roofing & Coatings, a contractor in Jamesport, Missouri is being fined $205,369 by OSHA for one willful, three serious, and one non-serious OSHA violation. This was after an employee, aged 18, who had been applying sealant on a roof of a commercial property fell over 22 feet. He suffered severe injuries and remained in a coma until he died five days later.
OSHA reported September 8 that after the worker fell, an employer permitted a supervisor and another employee to work without any fall protection for the remainder of their shift.
OSHA inspectors discovered that the employer provided fall protection equipment but let employees decide whether they would use it.
Investigators from the agency determined that in addition to failing to ensure employees were using fall protection, contractors failed to provide training on its use. The investigators found out that Troyer Roofing did not provide face and eye protective equipment to workers and had no written hazard communications program.
The construction industry’s fall protection standard is OSHA’s most-cited standard. It was cited 5,260 time in the fiscal year 2022. OSHA’s most-cited standard is its hazard communications standard. The agency’s next most-cited standard are the eye, face and fall protection standards.
In a statement, Karena Lorek of OSHA Kansas City’s area office said that Troyer Roofing & Coatings, the company responsible for this worker, could have avoided his death by requiring all employees to wear fall protection gear. The employer’s decision to allow other workers to return to the roof to continue working without using fall protection is disturbing.
